Terms and conditions

These terms and conditions apply to all agreements between Infinite Health (trading name of Remko Opdam, Dutch Chamber of Commerce number 95038329) and the client relating to personal training, nutrition guidance and related services. This English text is a translation provided for convenience. The Dutch version of these terms is the binding one, and in the event of any discrepancy the Dutch text prevails.
1. Definitions
- Infinite Health: Remko Opdam, trading under the name Infinite Health, Dutch Chamber of Commerce number 95038329.
- Client: the natural person who enters into an agreement with Infinite Health.
- Programme: an agreed package of personal training sessions and accompanying coaching, with a minimum term as offered on the website.
- Session: one agreed training slot of 60 minutes, unless agreed otherwise.
- Location: SportCity Haarlem Raaks, or another location designated by Infinite Health.
2. Applicability
These terms apply to all offers, quotations, agreements and services of Infinite Health, unless agreed otherwise in writing.
3. Formation of the agreement
The agreement is formed at the moment the client has completed the intake process and accepts the programme offered along with these terms and conditions. Before the start there is a free introductory conversation and intake, in which goals, physical condition and any limitations are discussed.
4. Rates and payment
- Current rates are stated on the website and in the programme agreement.
- Programmes are invoiced per 4 weeks. Payment is made in advance by invoice or iDEAL, within 14 days of the invoice date unless agreed otherwise.
- If payment is not made on time, Infinite Health is entitled to suspend its services until payment has been received.
- Infinite Health reserves the right to index its rates annually. Changes are announced at least one month in advance.
5. Term and cancellation
- Programmes have a minimum starting period of 4 months (17 weeks).
- After the starting period the agreement continues automatically in 4-week periods, at the same rate and the same frequency, unless the client cancels in good time.
- The notice period is one month, given verbally or in writing.
- Cancellation during the starting period is only possible in exceptional circumstances, such as medical reasons or relocation, and by mutual agreement.
6. Cancelling and missing sessions
- Scheduled sessions must be cancelled at least 24 hours in advance . If cancelled in time, a new session is scheduled at no cost.
- Sessions cancelled less than 24 hours in advance, or which the client does not attend, are at the client's expense and cannot be made up.
- In the event of illness or force majeure on the part of Infinite Health, a replacement slot is scheduled.
7. Results guarantee
Infinite Health offers a 100% results guarantee on the Transformation and Intensive programmes. The guarantee does not apply to the Foundation programme or the Introduction package.
The guarantee means that the client continues training at no extra cost after the minimum starting period of 17 weeks if there is no measurable result in weight, body fat percentage or strength. The guarantee applies subject to the following conditions:
- The client has attended at least 80% of the scheduled sessions.
- The client has consistently followed the nutrition plan provided by Infinite Health.
- The client has taken part in the interim progress measurements.
- There are no external factors disrupting the result that lie outside the influence of Infinite Health, such as pregnancy, serious illness or medication affecting the metabolism.
8. Client obligations
- At the start of the agreement the client declares that they are in sufficient physical and mental health to undertake the planned exertion, or that they have consulted a doctor.
- The client reports relevant medical conditions, injuries, medication or limitations before and during the programme.
- The client follows the instructions of Infinite Health regarding training technique and safety.
- Where sessions take place at SportCity Haarlem Raaks, SportCity's house rules also apply during the session.
9. Liability
- Infinite Health is not a doctor, physiotherapist or medical specialist. The advice and coaching provided are not a substitute for medical treatment or diagnosis.
- Participation in personal training sessions is at the client's own risk. The client is responsible for respecting their own physical limits and for reporting any complaints during or after a session.
- Infinite Health is liable only for direct damage resulting from intent or gross negligence on the part of Infinite Health. Liability for indirect damage, such as consequential loss, lost profit, missed savings or non-material damage, is excluded.
- Total liability is in all cases limited to the amount the client paid to Infinite Health in the three months preceding the event causing the damage.
10. Force majeure
Infinite Health is not obliged to fulfil any obligation if prevented from doing so by force majeure. Force majeure includes illness, serious injury, closure of the training location beyond its control, government measures and other circumstances outside the reasonable control of Infinite Health.
11. Privacy
The processing of personal data is governed by the Privacy statement of Infinite Health.
12. Changes to these terms
Infinite Health reserves the right to amend these terms and conditions. Changes are communicated to existing clients at least one month before they take effect. The most current version is always available on the website.
13. Governing law and disputes
All agreements between Infinite Health and the client are governed exclusively by Dutch law. Disputes arising from this agreement are resolved by mutual consultation wherever possible. If that is not successful, disputes are submitted to the competent court in Haarlem (Rechtbank Noord-Holland).
